> A federal judge in Mississippi denied xAI's motion to dismiss the NAACP's Clean Air Act lawsuit over unpermitted gas turbines that power its Memphis-area data centers. The court found the plaintiffs have standing, that the turbines are not 'mobile sources' under Mississippi's air plan and that the citizen-suit provision is constitutional. It has not yet ruled on a preliminary injunction.

The ruling does not decide whether xAI broke the Clean Air Act, but it removes the company's three main ways out of the case before any evidence is weighed. Its argument that the gas turbines powering its data centers were "mobile" and so needed no air permit was rejected, and so was its argument that groups like the NAACP cannot bring the case at all. How fast data-center operators can bring on-site power is becoming a legal question as much as an engineering one.

## What the court decided

The U.S. District Court for the Northern District of Mississippi denied xAI's motion to dismiss the NAACP's Clean Air Act lawsuit, in an opinion released late on Friday, October 30, CNBC reported. Judge Debra M. Brown wrote: "Because the plaintiffs have statutory standing under the Clean Air Act, because the combustion turbines are not 'mobile sources' under Mississippi's SIP, and because the citizen suit provision does not violate Article II of the Constitution or the private nondelegation doctrine, the plaintiffs' claims will proceed."

On xAI's argument that citizen suits are unconstitutional, the judge wrote: "Because citizen suit plaintiffs sue on their own behalf, in their own name, and seek penalties that redress harm to themselves, they are not exercising the federal government's executive power," according to TechCrunch and Earthjustice.

The decision came about two weeks after the same court rejected a request from the U.S. Department of Justice to end the case, CNBC reported. The court has yet to rule on the NAACP's motion for a preliminary injunction, according to Earthjustice, which represents the NAACP with the Southern Environmental Law Center (SELC).

## What the suit alleges

The SELC and Earthjustice filed the suit for the NAACP in April 2026. It alleges that between August and December 2025, xAI and its subsidiary MZX Tech installed and operated 27 gas turbines in Southaven, Mississippi, "without an air permit or regard for the health and safety of people living nearby," CNBC reported. xAI argued in its June motion to dismiss that the turbines were mobile and therefore exempt from permitting, that the NAACP had no right to sue under the Act and that such community suits were unconstitutional, according to CNBC.

Abre' Conner, the NAACP's director of environmental and climate justice, called the ruling "another important victory in our effort to hold xAI accountable." xAI is owned by SpaceX, which [acquired it in February](https://timesof.ai/2026/02/spacex-acquires-xai). SpaceX did not immediately respond to requests for comment from CNBC or TechCrunch.

## Limits

- We have not read the opinion itself. The quotations come from CNBC, TechCrunch and Earthjustice, and Earthjustice is counsel for the plaintiffs.
- The turbine count differs by source: CNBC gives the complaint's figure of 27 turbines in Southaven, while TechCrunch quotes the SELC as saying xAI ran "at least 35 combustion turbines and other sources of air pollution at the Colossus site." We have not reconciled the two.
- Earthjustice gives annual emissions estimates for the turbines. These are a party's claims, and we do not repeat them as fact.
- Denying a motion to dismiss is not a finding of liability. xAI has not commented on the ruling.
